- Deed – shows ownership of a property.The most common deeds are named below.
- Warranty Deed – a deed to real property which guarantees that the seller owns clear title which can be transferred.
- Quit Claim Deed – a deed to real property which does not offer a guarantee of title.
- Mortgage – pledges a property to the lender as security for payment of a loan. If the borrower doesn’t pay back the debt on time, the lender can sell the property to cover the debt. Instead of a mortgage, some states use a Deed of Trust.
- Deed of Trust – used in some states instead of a mortgage. Title to a property is conveyed to a trustee rather than to the borrower. The trustee holds the property for the lender until the debt is paid.
- Assignment of Mortgage – shows when ownership of a mortgage is transferred from one company or individual to another. Also called “Assignment of Mortgage
- Assignment of Deed of Trust – shows when ownership of a mortgage is transferred from one company or individual to another. Also called “Assignment of Mortgage” or “Assignment of Deed of Trust” depending on the state
- Release of Mortgage – shows that a mortgage has been paid off. Also called “Release of Mortgage” or “Release of Deed of Trust” depending on the state.
- Release of Deed of Trust – shows that a mortgage has been paid off. Also called “Release of Mortgage” or “Release of Deed of Trust” depending on the state.
- Satisfaction of Mortgage – shows that a mortgage has been paid off. Also called “Release of Mortgage” or “Release of Deed of Trust” depending on the state.
- Reconveyance – shows that the Deed of Trust has been paid off. Once a Deed of Trust has been paid, the Reconveyance is the document which passes ownership from the trustee (who has been holding it for the lender) to the borrower. Also called Deed of Reconveyance
- Judgement – A decision made by a court of law. In judgments that require the repayment of a debt, the court may place a lien against the debtor’s real property as collateral for the judgment’s creditor.
- Lien – shows a claim against a property that must be paid off when the property is sold.
- UCC Documents – (Uniform Commercial Code – a comprehensive code for commercial trade used in all 50 states) UCC filings show where personal property has been used as collateral. One provision of the UCC Code is the utilization of a UCC lien.
- Property Tax Report – shows the amount of the property tax, payment status and assessed value of the property
- Bankruptcy documents – Bankruptcy is a legal declaration that one is unable to pay one’s debts and thus needs to have debts forgiven or reorganized. There are many public documents filed from the initial voluntary or involuntary petition to the closing of the bankruptcy and final decree.
- Foreclosure Documents – Foreclosure is a procedure by which the holder of a mortgage takes possession of the property upon the failure of the debtor to pay and usually involves a forced sale of the property with the proceeds applied to the mortgage debt. There are many public documents filed such as a Notice of Default, Notice of Acceleration, Notice of Sale and more.
- Divorce Decree – The document issued after a divorce is declared final by the court.
- Power of Attorney – authorizes another person to act on one’s behalf. A Power of Attorney can grant complete authority or can be limited to certain acts and/or certain periods of time.
